Background InformationIt was by the marriage of Isabel, heiress of Sir Thomas of Lathom, to Sir John of Stanley, a Cheshire man, about 1385, that the Knowsley and Lathom estates came to the Stanleys. Other vast Lancashire properties were acquired through the forfeitures of the Wars of the Roses and the Reformation. In 1405 the lordship of Man and in 1414 the stewardship of Macclesfield came to the family. The properties of Sir Cleave Moore of Bankhall in Bootle, Kirkdale and Liverpool were acquired in 1724.
ArrangementOn my first inspection of the muniments at Knowsley I found them in great confusion.
The more important of the documents had been carefully calendared about the year 1844-5, but the deeds, not having been marked with the letters and numbers of reference assigned to them in the calendar, had got into confusion by reason of their having been taken from their respective bundles and not carefully replaced when done with. I found that the muniments had been calendared and arranged several times before 1844, but that each of these arrangements had failed for the same reason. It was therefore necessary to rearrange the deeds described in the calendar of 1844, and to incorporate with them a large mass of documents which had not been described at all.
To obviate the danger of confusion arising from carelessness in replacing particular documents in their proper bundles after use, a system of numbering has been adopted which may be described as follows:--The deeds and documents are arranged in bundles. To each bundle a number is assigned, and these "bundle numbers" or "principal numbers" run from number 1 to the end consecutively, but not completely, because certain of the numbers have been left blank for the purpose of inserting in the calendar in future times further documents of the various classes as they accrue. The principle to be observed in this system is that there shall be no two bundles of one denomination, so that there may be no possibility of a document being placed by mistake in a wrong bundle.The bundles consist of a varying number of documents; each of these documents in the bundle has marked plainly on it what may be called a sub-number, which indicates its place in the particular bundle to which it belongs, e.g., Bundle 107 consists of 22 documents; these are numbered DDK/107/1, 107/2, &c., down to DDK/107/22, and in the calendar these numbers are placed against the description of each particular document. Then, if it happens that document DDK/107/6 should be required for some purpose it can be taken out of the bundle and used, and can be restored to its proper place without difficulty by any one of the clerks.
Another advantage of this system is that the bundles can be removed from one part of the Muniment Room to another without danger of destroying the arrangement of them or making the calendar useless for purposes of reference. In fact, if by chance the whole of the muniments should happen to be disarranged, any person of ordinary intelligence could, by means of the numbers marked on the documents, rearrange them in the order in which they are described in the calendar. This system also admits of the addition to the calendar of the description of documents of various classes which will accrue from time to time, e.g., Bundle 44 is the last printed bundle number under the head of Grants, Family Deeds, &c. As further documents of this nature come into existence they can be marked DDK/45/1, 45/2, 45/3, &c., until a convenient sized bundle of them is completed, and then another bundle can be commenced and numbered DDK/46/1, 46/2, &c., a description of the deeds being entered in manuscript in the calendar with the reference numbers in the margin.The muniments have been divided under various heads as described below:--Grants, Family Deeds, &c.--The Royal Grants and documents relating to the Estates of the Earldom generally have been arranged in chronological order under the head of "Grants, Family Deeds, &c."; for under that title I found the bulk of them arranged in the existing Calendar of the Knowsley Muniments.
It is much to be regretted that so few of the ancient muniments of the family of Stanley remain at Knowsley. The loss of them is probably to be accounted for by the surrender of Lathom House (when the writings and evidences therein contained were given up to the officers of the Parliament) and by the subsequent seizure and sale of the seventh Earl's estates by the Parliament of the Commonwealth.Still more is it to be regretted that scarcely any ancient correspondence remains.Deeds and Conveyances.--In arranging the muniments and title deeds relating to the estates of the Earl of Derby described under the title of "Deeds and Conveyances," I have endeavoured so far as is possible to deal with them in topographical order, arranging the title deeds and other documents according to the towns and parishes in which the lands lie. Each bundle of deeds which relate to a particular farm or property has been marked with a number which is the chief or head number of the bundle, and each deed or paper in such bundle has been marked with a sub-number to identify it.The property to which the deeds relate having been identified has been coloured upon a sheet of the Ordnance Survey, and the number of the bundle of deeds which relate to it marked upon the coloured plot. The object of doing this has been to facilitate reference to the title deeds when any question arises in regard to a particular property. In making a reference to the muniments, recourse should first be had to the map, and the property in respect of which information is sought having been identified thereon, the number marked upon the map will give immediate reference to the bundle of the title deeds and also to the description of them in the printed calendar. The above remarks apply to properties, the greater part of which have been acquired within the present century.
The deeds relating to that portion of the estate which may be called the ancient estate of the Earldom could not be dealt with in this manner, because it was impossible to identify the particular plots of land with the ancient deeds. In compiling the coloured ordnance plans, therefore, I have taken the elaborate and careful survey of the estates of the Earldom made in 1789, and with the assistance of Mr. Hale I have marked on the Ordnance Sheet the ancient estates of the Earldom as shown on that survey, and have coloured them pink, the more recently acquired lands being coloured yellow; the lands which have been sold have been coloured black, and lands exchanged away have been coloured purple.The Calendar of the Deeds relating to the estates in the Fylde and at Preston has been prepared with great care by Mr. Gregson of the Preston Office.The Calendar of the Deeds relating to the estates in the counties of Kent and Surrey has been prepared under the direction of Mr. Lawrence.Deeds and Documents relating to the Estates not now belonging to the Earl of Derby.--There are a number of documents relating to lands not now part of the Earl of Derby's estate. Many of them are documents relating to lands which formerly belonged to the Earldom. Others appear to be documents which have come into the possession of the Earl of Derby on the purchase of the estates of Sir Cleave Moore. The late Earl of Derby instructed me to make searches amongst the Public Records and elsewhere with a view of writing a history of all the lands which at various times had been in the possession of the Stanley family. Some progress was made with the work, but it remains uncompleted.Royal Commissions, &c.--There are a number of Royal Commissions and appointments of various members of the family to offices under the Crown extending from the time of Henry VII. downwards.Particulars for the Sale of the Estates of James, Earl of Derby.--These are the Particulars made out by the Trustees of the Commonwealth when the Estates of the Earldom were sold. How these documents came into the possession of the Earls of Derby does not appear. They were probably handed over by the Government after the Restoration. They consist of elaborate valuations of the various manors and lands belonging to the late Earl. The collection, however, is not complete.Manor Court Rolls.--There is a considerable series of Court Rolls of the various manors belonging to the Earldom. They are all comparatively modern; no ancient rolls having been discovered.Surveys and Rentals.--Of these there is a large collection.Law Papers.--These consist of the papers relating to the various suits in which the Earls of Derby have been concerned; and extend from the time of James I. to 1796. Many interesting details of family history may be found in them.Stewards' Letters.--These consist of bundles of letters and correspondence between the Earls of Derby and their stewards and others with regard to the management of the household and the estates. They extend from 1746 to 1832. From these, also, may be gleaned many matters of family interest.Miscellaneous Letters.--These extend from 1706 to 1842, and relate to elections at Preston, sale of estates, the disturbances and riots of 1842, and other matters. The correspondence of the Earls of Derby subsequent to 1842 has not been calendared. There is also a collection of letters in the Library and in a wooden cabinet which has been placed in the Muniment Room.Papers relating to the Irish Estates.--These extend from 1747 to 1873, and consist of Surveys, Accounts, Rentals, and Valuations. They give interesting information as to the state of agricultural tenants in Ireland during that period.Documents relating to the Isle of Man.--These consist of grants by the Earls of Derby, Surveys, Court Rolls, Inventories, Rate Books, Law Proceedings, Correspondence extending from the middle of the 16th century to 1781; also Ministers' and Receivers' Accounts of the Island from 1522 to 1735. These documents form a valuable collection of historical material of a highly interesting character.Miscellaneous Documents.--These consist of documents which could not be assigned to any of the classes above mentioned. They comprise amongst other things a Rental of the Duchy of Lancaster in 1767, Poll Books, and papers relating to Elections for the County of Lancaster between 1695 and 1837, Papers relating to the Royal Lancashire Militia from 1719 to 1814, a Stud Book of the Earl of Derby from 1728 to 1755, a number of ancient Bailiffs' Accounts of the Manor of Culham and Hillingdon, Middlesex, and Ministers' Accounts of other Manors not now belonging to the Earldom, a book containing copies of the orders of the Court of Ormskirk for the regulation of the town, and a large bundle of deeds and settlements relating to the family of Hesketh of Rufford.Ministers' Accounts of the Earldom.--These are the Accounts of the Bailiffs, Receivers, and Stewards from the time of Henry VIII. to 1728, when the books known as Standing Rentals commence, and these are continued year by year down to the present time. There are also a quantity of Cash Books, Journals, Miscellaneous Account Books, and Letter Books of modern date.Leases and Counterpart Leases.--There is at Knowsley a large collection of surrendered leases and counterparts of leases of lands of the Earldom. They extend from the middle of the 16th century downwards. The more ancient are tied up in bundles and labelled with the name of the estate to which they relate, and of these earlier ones there appears to be no schedule or calendar. The more modern leases are calendared in books called Registers of Leases, which commence in the middle of the last century and are continued up to the present time. Finding that under this system of registry, which had been carefully carried on down to the present day, no difficulty was experienced in referring to and replacing these documents, I deemed it inadvisable to interfere with the arrangement in existence, and therefore no reference is made in this Calendar to this class of documents.These leases afford interesting evidence of the working of the system of granting leases for lives, upon fines, and at a small yearly rent, whereby a quasi-permanent tenure was given to the tenant. They show instances of farms held by members of the same family from generation to generation for very long periods, in some cases extending to two and three centuries.The old Muniment Room being found to be damp and insufficient for the custody of the muniments, the late Earl caused the present strong room to be built at my suggestion. It is well arranged in point of ventilation--a most important matter with regard to the preservation of ancient documents. The fireproof windows should be kept open as much as possible during dry weather, and warm air should be introduced from time to time during the winter months. The documents taken from the old strong room were very damp and fast falling to decay. Within a few weeks of their removal to the new room they became dry and in good condition by reason of the passage of the air through the windows of the room. In placing bundles of documents in a Muniment Room I strongly advised that they should not be wrapped up in paper, but simply covered up to protect them from falling dust; for experience has shewn me that there is no more effectual way of causing documents to decay than wrapping them tightly in paper and leaving them in a damp place. I cannot conclude these remarks without acknowledging in the fullest terms the debt of gratitude which I owe to Mr. Hale for his valuable assistance and guidance in helping me to identify the properties, and to carry out my work. To Mr. Ward and the Staff of the Knowsley Office I am greatly indebted for almost daily help; and also to Mr. Johnson, who was appointed to assist me, for his carefulness and intelligence in carrying out my directions, and keeping the documents in order during the preparation of this Calendar.
